In accordance with the amended Constitution of the Federal Republic of Nigeria and the Electricity Act 2023 (as amended), the Nigerian Electricity Regulatory Commission (NERC) has issued an order transferring regulatory oversight of the electricity market in Plateau State to the Plateau State Electricity Regulatory Commission.
Under the provisions of the Electricity Act 2023, NERC remains the central regulator, maintaining oversight of inter-state and international generation, transmission, supply, trading, and system operations.
The Electricity Act (EA) also requires any state seeking to establish and regulate an intrastate electricity market to formally notify the Nigerian Electricity Regulatory Commission (NERC) of its processes and request the transfer of regulatory authority over electricity operations to the state regulator.
In a statement released via its X handle on Friday, NERC confirmed that the Plateau State Government has fulfilled the necessary legal requirements, duly notifying NERC and requesting the transfer of regulatory oversight for the intrastate electricity market in the state.
As part of the transfer order, NERC directed Jos Electricity Distribution Plc (JED) to establish a subsidiary, JED SubCo, to take over responsibilities for intrastate electricity supply and distribution in Plateau State.
“JED shall complete the incorporation of JED SubCo within 60 days from 12th March 2025. The sub-company shall apply for and obtain a licence for intrastate electricity supply and distribution from the Plateau State Electricity Regulatory Commission (PSERC), among other directives.
“All transfers outlined in this order shall be finalized by 12th September 2025,” NERC stated.
With this order, Plateau State has joined Lagos, Imo, Ogun, Ondo, Ekiti, Enugu, Niger, Edo, and Oyo in regulating its electricity market.
