The Lagos State High Court in Ikeja has declared the removal of Mudashiru Obasa as Speaker of the Lagos State House of Assembly illegal and unconstitutional.
Delivering the judgment on Wednesday, Justice Yetunde Pinheiro nullified the Assembly’s proceedings and resolutions of January, which led to Obasa’s ouster, describing the process as a violation of legislative procedures and constitutional provisions.
Obasa had filed a suit challenging the legality of his removal while the Assembly was on recess and he was outside the country. He argued that 36 lawmakers held a session without his authority or a formal delegation of power, contrary to the Assembly’s Standing Orders and the 1999 Constitution (as amended).
Represented by his counsel, Chief Afolabi Fashanu (SAN), Obasa maintained that the session that produced Mojisola Meranda as the new Speaker was invalid.
The suit, based on nine legal grounds, referenced both constitutional and procedural breaches. The court upheld these arguments, effectively reversing the legislative action taken against the embattled lawmaker.
Despite interventions, including one reportedly from President Bola Tinubu, Obasa pursued the case to its conclusion, signaling a determination to reclaim his position through legal means.
